These Terms and Conditions are meant for you to understand your rights, privileges, and responsibilities towards Atlantis Digital Marketing LLC. By accessing this website and using any of our services or products you accept and agree to be bound to comply with the Terms and Conditions mentioned on this page.
Understand that the following terminology applies to these Terms and Conditions and any or all Agreements: ”Client”, “Users, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.
1.0 Copyrights and Intellectual Property
All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on Atlantis Digital Marketing Services and Content belong to Atlantis Digital Marketing. Nothing in the Terms grants you a right or license to use any trade mark, design right or copyright owned or controlled by the Atlantis Digital Marketing or any other third party except as expressly provided in the Terms.
2.0 Content and Information
All content and information written on AtlantisDigitalMarketing.com aims to use proper language and accurate information. In the case of errors, we are not held responsible for any promises or general information on this website.
Atlantis Digital Marketing does not control user submitted Content and, as such, does not guarantee the accuracy, integrity or quality of such Content.
We reserve the right to eliminate any content or comment that uses inappropriate language or profanity, shows racism, provides inaccurate information or in any way does not share Atlantis Digital Marketing’s core values.
3.0 Condition of Use
As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably intended by Atlantis Digital Marketing.
You are not to advertise or solicit, any user to buy or sell any third party products or services, or to use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent. You also agree not to use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission.
4.0 Disclaimer of Warranties
Atlantis Digital Marketing does not guarantee, represents or warrant that your use of this website, products or services will be error-free and you agree that Atlantis Digital Marketing may terminate services at any given time if considered necessary with no previous notice.
5.1 Payment Gateway
We accept all major credit/debit cards as payment methods and use PayPal as a third party provider for payment processing, therefore, PayPal’s terms and conditions are meant to comply during any transaction.
If the payment provider is changed, all clients must be notified via email or phone call at least 24hrs in advance.
Invoices will ALWAYS include Atlantis Digital Marketing branding, logo and contact information. It will also provide detailed information on each charge, service and period charged.
5.3 Payment Due Dates
Every client will be provided with their payment due date and frequency of charge upon subscription.
5.3.1 Prepaid Clients Payment Due Date and Policy
Prepaid clients will be provided 7 calendar days as a grace period to process their payments counting from their stipulated due date.
Should the grace period be exhausted, Atlantis Digital Marketing reserves the right to charge a 3% late fee of the amount due.
For example, if the payment due date is the 3rd of the month for the amount of $200 and the client processes the payment on or after the 10th of the month, the client will be charged $206 total.
5.3.1 Postpaid Clients Payment Due Date and Policy
Postpaid clients will be provided 5 calendar days to process their payments counting from their stipulated due date. IfShould the grace period be exhausted, Atlantis Digital Marketing reserves the right to charge a 3% late fee of the amount due.
For example, if the payment due date is the 3rd of the month for the amount of $200 and the client processes the payment on or after the 8th of the month, the client will be charged $210 total.
6.0 Cancellation Policy
Cancellations are effective immediately. Services can only be restored with no additional fees if both parties agree within a 30 calendar days period.
6.1 Prepaid Clients Cancellation
Prepaid clients are free to cancel at any given time after the first 90 days of using our services; unless they have other agreements restrictions for multiple services or payments accommodations.
The client has the responsibility to notify their direct account manager assigned by Atlantis Digital Marketing 5 business days prior to their payment due date.
If the client fails to notify prior to the given timeframe we are not held responsible for any automatic charge processed. In case the charge goes through please review our Refund Policy and contact your assigned account manager to process the dispute.
If a prepaid client chooses to cancel our services prior to the 90 days commitment; he/she is bound to comply with the full 90 days payment of established service fees.
6.2 Postpaid Clients Cancellation
Postpaid clients are free to cancel at any given time after the first 180 days of using our services unless they have other agreements restrictions for multiple services or payments accommodations. The client has the responsibility to notify their direct account manager assigned by Atlantis Digital Marketing 10 business days prior to their payment due date.
If the client notifies in the right timeframe, he/she will only be charged for the month of service provided. For example: the client’s due date is on the 20th of month “X” and notifies 10 business days prior to the 20th of month “X”, the client is bound to pay the full invoice for the 20th of month “X” since it would correspond to his/her last billing cycle.
If the client fails to notify prior to the given timeframe (10 business days) and does it within the 10 business days prior to their due date, then the client will be charged in full the given month of services provided plus 20% of that month’s invoice.
In case the client cancels the services and 5 calendar days have passed after her/his due date then the charge for the upcoming invoice will also be in full as well.
If a postpaid client chooses to cancel our services prior to the 180 days commitment; he/she is bound to comply with the full 180 days payment of established service fees.
7.0 Atlantis Digital Marketing Cancellations
Atlantis Digital Marketing reserves the right to cancel services at any given time if the client doesn’t comply with the Terms and Conditions specified on this website or Terms agreed separately with the client. Also, Atlantis Digital Marketing reserves the right to provide details of the reason for terminating an agreement.
8.0 Refund Policy
Every refund request is thoroughly investigated. If it’s found that Atlantis Digital Marketing charged the client any given amount by error, a full refund will be issued to the client in the following 10 business days after the investigation is completed.
Refund investigations should take no longer than 3 business days unless a longer period is necessary. For extraordinary cases, we reserve the right to continue the investigation for up to 6 months.
If a prepaid client was charged an invoice because he/she failed to request a cancellation in the proper timeframe stipulated on these Terms, a partial refund will be processed for the amount charged minus a 6% transaction fee.
Atlantis Digital Marketing does not provide refunds in any of the circumstances below, though is not limited to:
- Prepaid clients requesting a refund in the first 90 days of using our services.
- Postpaid clients requesting a refund in the first 180 days of using our services.
- When a service had already been provided for the charged amount.
- When there is a mutual agreement that services contract is extended for a specific period of time
9.0 Notification Policy
Atlantis Digital Marketing may perform changes to these terms and conditions at any given time without previous notice.
Clients with an active agreement will receive a “Terms and conditions update” alert.
10.0 Governing Law
These terms and conditions are governed by the laws of the United States of America and the laws of the State of Wyoming.
ANY PARTICIPATION IN THIS SITE WILL CONSTITUTE ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THE ABOVE, PLEASE DO NOT USE THIS SITE.
